PLEASE READ THESE TERMS OF USE CAREFULLY.  BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE.  IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.

These Website Terms (“Terms”) apply to your access to the website of the Bezos Family Foundation (the “Foundation”) located at www.bezosfamilyfoundation.org (collectively the "Foundation Site"). For the Terms applicable to the various program sites operated by the Foundation, please see the websites for such programs: Bezos Scholars Program; Students Rebuild; and Vroom (the “Program Sites”). 

We may make changes to these Terms from time to time. If we make material changes, we will provide notice of such changes by updating the date at the top of these Terms, providing a notice through the Foundation Site, or other means we deem appropriate. Your continued use of the Foundation Site after we provide such notice will confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using the Foundation Site.

1. Privacy

For information about how we collect, use, share or otherwise process information about you, please see our Privacy Policy.

2. Ownership; Limited License

The Foundation Site and all text, graphics, images, photographs, videos, illustrations, resources, educational materials, and other content contained therein (collectively the “Site Content”) is owned by the Foundation or our licensors and is protected under both United States and foreign laws. Except as explicitly stated in these Terms, all rights in and to the Foundation Site and the Site Content are reserved by us or our licensors. Subject to your compliance with these Terms, you are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use the Foundation Site solely for your own personal, noncommercial use. Any use of the Foundation Site or the Site Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited, will terminate the license granted herein, and violate our intellectual property rights.

3. Repeat Infringer Policy; Copyright Complaints

Certain of the Program Sites may include content that is provided by users. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, the Foundation had adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers in connection with such content. The Foundation may at its sole discretion limit access to any Program Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

If you believe that anything on the Foundation Site or any of the Program Site infringes upon any copyright which you own or control, you may file a notification of such infringement with our Designated Agent, as set forth below.

4. Prohibited Conduct

You are solely responsible for your conduct while using the Foundation Site. You will not:

  • Sell, resell, copy, modify, or commercially use the Foundation Site or Site Content;

  • Use the Foundation Site or Site Content other than for their intended purpose and in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Foundation Site or Site Content or that could damage, disable, overburden or impair the functioning of the Foundation Site in any manner;

  • Reverse engineer any aspect of the Foundation Site or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of the Foundation Site;

  • Use any data mining, robots or similar data gathering or extraction methods designed to scrape or extract data from the Foundation Site; or

  • Access or use the Foundation Site or Site Content for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.

5. Trademarks

BEZOS FAMILY FOUNDATION and our logos, program names, slogans, and the look and feel of the Foundation Site are trademarks of the Foundation and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned on the Foundation Site are the property of their respective owners. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us.

6. Feedback

If you submit or otherwise communicate to us any questions, comments, suggestions, ideas, original or creative materials or other information about the Foundation, its programs, the Foundation Site or any Program Sites (collectively, “Feedback”). You understand that such Feedback is not confidential and that we are free to use such Feedback for any purpose without acknowledgment or compensation to you.

7. Third-Party Content

The Foundation Site may contain information about third-party websites, organization, products, services, activities or events (collectively, “Third-Party Content”). We provide Third-Party Content as a service to those interested in such content. Your dealings or correspondence with third parties and your use of or interaction with any Third-Party Content are solely between you and the third party. We do not control or endorse, and make no representations or warranties regarding, any Third-Party Content, and your access to and use of such Third-Party Content is at your own risk.

8. Disclaimers

Your use of the Foundation Site is at your sole risk. The Foundation Site and any Site Content contained therein are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, the Foundation does not represent or warrant that the Foundation Site or Site Content are accurate, complete, reliable, current or error-free. While we attempt to make your use of the Foundation Site and Site Content safe, we cannot and do not represent or warrant that the Foundation Site or servers are free of viruses or other harmful components. You assume the entire risk as to the quality and performance of the Foundation Site.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the Foundation and our officers, directors, agents, employees, founders, and partners (the “Foundation Parties”) are not liable to you under any theory of liability—whether based in contract, tort, negligence, warranty, or otherwise—for any indirect, consequential, incidental, or special damages or lost profits, even if the Foundation or the other Foundation Parties have been advised of the possibility of such damages. The total liability of the Foundation and the other Foundation Parties for any claim arising out of or relating to these Terms or the Foundation Site, regardless of the form of the action, is limited to $10.00. The limitations set forth in this Section 9 will not limit or exclude liability for the gross negligence, fraud or intentional misconduct of the Foundation or the other Foundation Parties or for any other matters in which liability cannot be excluded or limited under applicable law. Additionally, some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

10. Release

To the fullest extent permitted by applicable law, you release the Foundation and the other Foundation Parties from responsibility, liability, claims, demands and/or damages (actual and consequential) of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties. If you reside in California, you hereby waive your rights under California Civil Code § 1542, which provides: “A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

11. Transfer and Processing Data

In order for us to provide the Foundation Site, you agree that we may process, transfer and store information about you in the United States and other countries, where you may not have the same rights and protections as you do under local law.

12. Governing Law and Venue

Any dispute arising from these Terms and your use of Foundation Site will be governed by and construed and enforced in accordance with the laws of Washington, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles (whether of Washington State or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court will be resolved in the state or federal courts of the State of Washington and the United States, respectively, sitting in King County, Washington.

13. Modifying and Terminating the Foundation Site

We reserve the right to modify the Foundation Site or to suspend or stop providing all or portions of the Foundation Site at any time. You also have the right to stop using the Foundation Site at any time. We are not responsible for any loss or harm related to your inability to access or use the Foundation Site or Site Content.

14. Severability

If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

15. Miscellaneous

These Terms constitute the entire agreement between you and the Foundation relating to your access to and use of the Foundation Site and Site Content. The failure of the Foundation to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity.
